Commercial General Liability and Errors and Omissions Insurance
More and more companies are demanding that the freelancers they contract carry varying amounts of liability and errors and omissions insurance, making proof of such coverage a condition of a granting a commission. This marks a departure from contracts of the past and represents a ‘downloading’ of liability and costs associated with defending a suit onto the freelancer. We suggest you talk about these clauses in the contract with the employer and find out why they consider them necessary and whether they are open to changing some of the language.
